    Terms of service

    These Terms of Service govern your use of the Beverly Hills Perfumery website and your purchase of products from us. By accessing the website, creating an account, or placing an order, you agree to these Terms and to our Privacy, Shipping, and Refund Policies.

    Online store terms

    You must be at least the age of majority in your state of residence, or use the website with the involvement and consent of a parent or legal guardian. You may not use the website or our products for an unlawful or unauthorized purpose.

    Product information

    We make reasonable efforts to display product descriptions, sizes, colors, packaging, ingredients, availability, and prices accurately. Product appearance and packaging may change, and colors may look different depending on your display. If information is materially incorrect, please contact us.

    Fragrance preferences and performance are personal and can vary by wearer, environment, and application. Descriptions of scent, longevity, or similar characteristics are informational and are not guarantees.

    Orders and payment

    Submitting an order is an offer to purchase. We may accept, decline, or cancel an order, including when an item is unavailable, pricing or product information is incorrect, payment cannot be authorized, fraud is suspected, or an order violates purchase limits or these Terms. If we cancel an order after payment, we will issue the appropriate refund.

    You agree to provide current, complete, and accurate purchase, billing, shipping, and account information. Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes and shipping charges are presented at checkout.

    Promotions and availability

    Promotions, gifts, samples, discounts, and offers are subject to their stated terms, availability, and any applicable limits. We may modify or end an offer as permitted by law. Product quantities may be limited.

    Shipping, returns, and refunds

    Shipping is governed by our Shipping Policy. Returns, exchanges, and refunds are governed by our Refund Policy. Those policies are incorporated into these Terms.

    Intellectual property

    The website and its content—including text, graphics, logos, photographs, videos, product presentation, and design—are owned by Beverly Hills Perfumery or used with permission and are protected by applicable intellectual-property laws. You may use the website for personal, noncommercial shopping purposes. You may not reproduce, distribute, modify, sell, exploit, or create derivative works from website content without prior written permission.

    Third-party services and links

    The website may use or link to services operated by third parties, including Shopify, payment processors, carriers, social platforms, and other providers. Their services may be governed by separate terms and privacy practices. We are not responsible for third-party websites or services except as required by law.

    Prohibited conduct

    You may not interfere with the website’s security or operation; introduce malicious code; scrape or harvest data without authorization; impersonate another person; submit false information; infringe another party’s rights; or use the website to violate applicable law.

    Disclaimer and limitation of liability

    To the fullest extent permitted by law, the website and services are provided “as is” and “as available.” We do not exclude warranties, remedies, or liabilities that cannot lawfully be excluded.

    To the fullest extent permitted by law, Beverly Hills Perfumery will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or services. Nothing in these Terms limits liability where doing so would be unlawful.

    Indemnification

    To the extent permitted by law, you agree to indemnify and hold Beverly Hills Perfumery harmless from third-party claims arising from your unlawful use of the website or your material violation of these Terms.

    Governing law

    These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules. Any dispute will be handled in a court with lawful jurisdiction, subject to any rights you have under applicable consumer law.

    Changes and severability

    We may update these Terms by posting a revised version and changing the “Last updated” date. If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.

    MOBILE TERMS OF SERVICE

    BEVERLY HILLS PERFUMERY

    The Beverly Hills Perfumery mobile message service (the “Service”) is operated by Beverly Hills Perfumery (“Beverly Hills Perfumery,” “we,” or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

    By consenting to Beverly Hills Perfumery’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Beverly Hills Perfumery through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

    You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Beverly Hills Perfumery. Your participation in this program is completely voluntary.

    We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

    You may opt out of the Service at any time. Text the single keyword command STOP to +1 310-666-8131 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Beverly Hills Perfumery mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

    We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

    The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

    To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
